MINUTES OF REGULAR MEETING OF TAWAS CITY COUNCIL August 3, 2009 Mayor Walters called the regular meeting of the Tawas City Council to order at 7:30 p.m. in the council chamber at the Tawas City Hall. Council Members Present: Brent Babcock, Sandra Brugger, Dave Dickman, Kane Kelly, Dave Schantz, and Duane Walters. Council Members Absent: Tim Stonehouse Others Present: City Manager Mark Moers, City Clerk Michelle Westcott Mayor Walters offered the Pledge of Allegiance to the Flag and a moment of meditation. Dickman moved, Brugger seconded, CARRIED, to accept the agenda of the August 3, 2009 regular council meeting. Roll Call Vote: Yes - Brugger, Dickman, Kelly, Schantz, Walters, Babcock. No - None. Schantz moved, Dickman seconded, CARRIED, to approve the minutes of the July 20, 2009 regular meeting as presented. Roll Call Vote: Yes - Dickman, Kelly, Schantz, Walters, Babcock, Brugger. No - None. Schantz moved, Babcock seconded, CARRIED, to approve the Claim Sheet 080309 as presented. Roll Call Vote: Yes - Kelly, Schantz, Walters, Babcock, Brugger, Dickman. No - None. City Manager Moers reported the CDBG Grant for the Second Avenue Lift Station was denied with another opportunity to apply for the grant this fall. City Manager Moers stated he will file a claim with Consumers Energy and the insurance agency for reimbursement of the damages to the Second Avenue Lift Station caused by the power outage. Dickman moved, Brugger seconded, CARRIED, to adopt the resolution to authorize the City Clerk, Michelle M. Westcott and City Manager, Mark D. Moers to sign the MDOT Contract No. 09-5373 to accept the contract for First Street from Court Street easterly to Highway US-23 (SBM 1158). Roll Call Vote: Yes - Schantz, Walters, Babcock, Brugger, Dickman, Kelly. No - None. City Manager Moers stated the Relay for Life of Iosco County 2010 committee would like to host the event at the Tawas City Park on June 12 and 13, with set up beginning on Friday June 11. The event will begin at 10:00 a.m. on June 12th and end at 10:00 a.m. on June 13th with approximately 2,000 participants. Brugger moved, Schantz seconded, CARRIED, to allow the Relay for Life of Iosco County to use the Tawas City Park June 11, 12, and 13 for a 24 hour event to start on June 12th at 10:00 a.m. with condtions to be set by the City Manager on the requirements and restrictions of the park. Roll Call Vote: Yes - Walters, Babcock, Brugger, Dickman, Kelly, Schantz. No - None. City Manager Moers reported the City is furnishing private fire protection lines at no charge. The City water ordinance states under Section 30-88 (f) "No free service shall be furnished by the system to any person, firm, or corporation, public or private, or to any public agency or instrumentality". The Council discussed the different fee options for the private fire protection line from other municipalities. Mayor Walters requested the City Manager provide the Council with a list of suggested charges at the next meeting. City Manager Moers reported that East Tawas is reviewing implementing a cell phone ordinance. The ordinance would restrict hands on cell phone use while operating a vehicle. Discussion was held on the possibility of implementing the cell phone ordinance. The consensus of the Council is to postpone and explore the cell phone ordinance until the next meeting. Babcock moved, Brugger seconded, CARRIED, to approve the name of the entire park across from City Hall as "Veteran's Park" and the portion within the park designated for the veteran's monument will be named "Veteran's Recognition Plaza". Roll Call Vote: Yes - Babcock, Brugger, Dickman, Kelly, Schantz, Walters. No - None. Councilmember Dickman updated the Council on the Michigan Walleye Tour State Championship hosted by Tawas City and East Tawas on August 13-15. Councilmember Brugger thanked the DPW, Council, and Mayor for the support on the Tawas Bay Fine Arts Show last weekend. She requested two posts be installed at Gateway Park for event banners to be displayed. Councilmember Schantz complimented on the letters installed at city hall and requested a pedestrian walk be painted on Mathews Street. Councilmember Babcock complimented the City Manager on the information presented on the private fire protection line charges. Mayor Walters stated how nice and enjoyable the Tawas Bay Fine Arts Show was this weekend. The next regular meeting of the Tawas City Council is scheduled for Monday, August 17, 2009, at 7:30 p.m. at the Tawas City Hall.
