Mayor Walters called the regular meeting of the Tawas City Council to order at 7:30 p.m. in the council chamber at the Tawas City Hall.

Council Members Present:      Brent Babcock, Sandra Brugger, Kane Kelly, Dave Schantz, Tim Stonehouse and Duane Walters.

Council Members Absent:      Dave Dickman.   

Others Present:                        City Manager Mark Moers, City Clerk Michelle Westcott

Mayor Walters offered the Pledge of Allegiance to the Flag and a moment of meditation.

Stonehouse moved, Schantz seconded, CARRIED, to accept the agenda of the June 15, 2009 regular council meeting. Roll Call Vote:  Yes - Brugger, Kelly, Schantz, Stonehouse, Walters, Babcock.  No - None.

Brugger moved, Stonehouse seconded, CARRIED, to approve the minutes of the June 1, 2009 regular meeting as presented. Roll Call Vote:  Yes - Kelly, Schantz, Stonehouse, Walters, Babcock, Brugger.  No - None. 

Schantz moved, Kelly seconded, CARRIED, to approve the Claim Sheet 061509 as presented.  Roll Call Vote:  Yes - Schantz, Stonehouse, Walters, Babcock, Brugger, Kelly.  No - None.

Stonehouse moved, Brugger seconded, CARRIED, to approve the Tawas Hardware bill in the amount of $997.33.  Roll Call Vote:  Yes - Stonehouse, Babcock, Brugger, Kelly, Schantz.  No - None.  Abstain - Walters.

Stonehouse moved, Schantz seconded, CARRIED, to approve the Huron Sports bill in the amount of $405.00.  Roll Call Vote:  Yes - Walters, Babcock, Brugger, Schantz, Stonehouse.  No - None.  Abstain - Kelly.

Brugger moved, Stonehouse seconded, CARRIED, to approve the Fire Station expansion pay request # 6 in the amount of $21,844.00 for asphalt and painting.  Roll Call Vote:  Yes - Babcock, Brugger, Kelly, Schantz, Stonehouse, Walters.  No - None.

Schantz moved, Kelly seconded, CARRIED, to adopt the resolution approving a $25,000.00 transfer from the Major Street fund to the Local Street fund which was budgeted for the purpose of street improvements for the fiscal year 2008-2009 (SBM 1151).   Roll Call Vote:  Yes -Brugger, Kelly, Schantz, Stonehouse, Walters, Babcock.  No - None.

Stonehouse moved, Kelly seconded, CARRIED, to approve ordering a 12" x 10" Gordon Clute Memorial Park plaque with post for the new library park in the amount of $335.00. The Kiwanis Club could donate $100.00 for the plaque. Roll Call Vote:  Yes - Kelly, Schantz, Stonehouse, Walters, Babcock, Brugger.  No - None.

Stonehouse moved, Brugger seconded, CARRIED, to reappoint Fred Todd for a three year term expiring July 2, 2012 to the Tawas City Building Authority. Roll Call Vote:  Yes - Schantz, Stonehouse, Walters, Babcock, Brugger, Kelly.  No - None.

Schantz moved, Stonehouse seconded, CARRIED, to adopt the resolution for the fiscal year end 2008-2009 budget amendments (SBM 1152).  Roll Call Vote:  Yes - Stonehouse, Walters, Babcock, Brugger, Kelly, Schantz.  No - None.

City Manager Moers stated 301 Elms Avenue is on the list of property foreclosures from the State of Michigan for delinquent property taxes.  If the City purchases the property, the City could eliminate a blight structure in a commercial district.  This would allow the opportunity for a new business to develop the property in the commercial district. Brugger moved, Schantz, seconded, CARRIED, to purchase lots 9, 10, and 11 of First Addition to the Elms in Tawas City located at 301 Elms Avenue, Property Code 132 T30 000 009 00 and 132 T30 000 010 00 in the amount of $6,689.34 plus the application fee of $300.00 from the State of Michigan.  The City has the first right of refusal before the State would sell at a public auction with a deadline of July 7, 2009 for the City to respond (SBM 1153).  Roll Call Vote:  Yes - Walters, Brugger, Kelly, Schantz, Stonehouse.  No - Babcock.

Brugger moved, Kelly seconded, CARRIED, to transfer the date for the East Tawas Assembly of God Big Truck Fundraiser in Gateway Park from August 29^th to August 22^nd.   Roll Call Vote:  Yes - Babcock, Brugger, Kelly, Schantz, Stonehouse, Walters.  No - None.

Betty Fahselt-Senter from the Tawas Bay Artists gave an update on Tawas City Fine Art Festival on August 1^st and 2^nd.

Jerry Malone requested to use the Tawas City Park on July 10^th for the Summerfest Mayor Fish Boil and waive the fees.  He also invited Mayor Walters to attend the fish boil.  Stonehouse moved, Brugger seconded, CARRIED, to allow the Summerfest Committee to use the Tawas City Park on July 10^th for the Mayors Fish Boil and waive the fees.  Roll Call Vote:  Yes - Brugger, Kelly, Schantz, Stonehouse, Walters, Babcock.  No - None.

Councilmember Brugger stated the non-profit organization that hosted the phragmite seminar stated there are funds available up to 75% of the cost to treat the phragmites for the City.   The Parks and Recreation Board will be holding a rummage sale in the Tawas City Park on June 27^th to raise funds for the Veterans Memorial Park.

Councilmember Kelly stated the Huron Skate and Roller Park equipment was assembled June 14^th with volunteers and the kids are using the park.  City Manager Moers stated the City will apply dust control to the driveway and fill in part of the ice skating rink to add additional parking.

Councilmember Babcock requested to be excused from the July 6^th meeting.    

The next regular meeting of the Tawas City Council is scheduled for Monday, July 6, 2009, at 7:30 p.m. at the Tawas City Hall.
